{"id":12447,"date":"2022-07-04T08:52:07","date_gmt":"2022-07-04T08:52:07","guid":{"rendered":"https:\/\/www.immigrationxperts.com\/updates\/?p=12447"},"modified":"2022-07-04T10:46:45","modified_gmt":"2022-07-04T10:46:45","slug":"australias-latest-immigration-visa-rule-changes-effective-from-1st-july-2022","status":"publish","type":"post","link":"https:\/\/www.immigrationxperts.com\/updates\/australias-latest-immigration-visa-rule-changes-effective-from-1st-july-2022\/","title":{"rendered":"Australia&#8217;s Latest Immigration\/Visa Rule Changes, Effective From 1st July 2022"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">With Australia stepping into the post-COVID era, the government has introduced certain immigration and visa rule changes intending to spur economic recovery and tackle skilled labor shortages many industries are going through.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">These changes, which came into effect on <\/span><b>1st July 2022<\/b><span style=\"font-weight: 400;\">, will act as a boon for skilled migrant workers who opted to stay back in the country during the pandemic by enhancing their access to permanent residence (PR.)<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Read on as we discuss these visa changes in detail below.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Major Australian Immigration\/Visa Changes Applicable From 1st July 2022<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Here are the immigration\/visa changes the <\/span><a href=\"https:\/\/www.homeaffairs.gov.au\/\"><span style=\"font-weight: 400;\"><span style=\"color: #3366ff;\">Australian Department Of Home Affairs<\/span><\/span><\/a><span style=\"font-weight: 400;\"> (DHA) has implemented from 1st July 2022.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><b>Temporary Skill Shortage (TSS) Visa Holders In The Short-term Stream<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">If you&#8217;re a TSS visa holder in the short-term stream, you can now apply for the PR visa through the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) subclass 186 visa, provided:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u2022 You&#8217;ve stayed in Australia for a minimum of one year between 1 February 2020 and 14 December 2021<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u2022 You meet the general 186 visa criteria under the 186 temporary transition stream<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u2022 You must work for a sponsor employer while holding a 482 visa for at least three years<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Important: <\/b><span style=\"font-weight: 400;\">This pathway is accessible for two years, starting from 1 July 2022.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It&#8217;s worth noting that Temporary Work Skilled subclass 457 visa holders with an occupation on the <\/span><span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/immi.homeaffairs.gov.au\/visas\/working-in-australia\/skill-occupation-list\"><span style=\"font-weight: 400;\">Short-term Skilled Occupation List<\/span><\/a><\/span><span style=\"font-weight: 400;\"> (STSOL). As a result, subclass 457 visa holders need not apply first for the TSS visa for the TRT stream of the ENS subclass 186 visa.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><b>Extension Of The Grandfathering Arrangements In Place For 457 Visa Holders<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The Australian government body has further extended the grandfathering arrangements in place for 457 visa holders who applied for a subclass 457 visa as of 18 April 2017.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">This arrangement was set to end last year in March. However, the government declared this extension to give 457 visa holders access to PR visa holders even if they don&#8217;t meet the age requirement.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">For this to happen:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u2022 You must have held a subclass 457 visa on 18 April 2017<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u2022 You must have applied for a subclass 457 visa on or before 18 April 2017 that was granted<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Note: <\/b><span style=\"font-weight: 400;\">The visa holder doesn&#8217;t need to hold the same subclass 457 visa still to be eligible for this grandfathering arrangement.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><b>Replacement Stream For Temporary Graduate Visas SC 485<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">If you&#8217;re among those SC 485 visa holders who couldn&#8217;t stay back in Australia for the whole period of their previous visa owing to the various pandemic restrictions, then the replacement stream is for you.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Here are the eligibility terms:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You must hold or have previously held a temporary graduate visa SC 485 that expired on or after 01 February 2020<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You&#8217;ve been outside Australia between 1 February 2020 and 15 December 2021<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><b>Note: <\/b><span style=\"font-weight: 400;\">The Replacement 485 visa must be lodged before 1 January 2027. Furthermore, you must hold the original 485 visa and not the second visa.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li aria-level=\"1\"><b>Nominated Occupation And Skills Assessment Aren&#8217;t Required Temporarily For Subclass 485 \u2013 Graduate Work Stream<\/b><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Another significant alteration in the Australian visa rules is the triviality of the Nominated Occupation and Skills Assessment. This allows thousands of foreign students to stay and contribute to the Australian labour market with their skills.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">FYI, this applies to applications lodged between 01 July 2022 and 30 June 2023 (inclusive.)<\/span><\/p>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li aria-level=\"1\"><b>Working Holiday Visa<\/b><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Besides the COVID restrictions, most Australian industries also started facing an immense shortage of skilled laborers who moved back to their homeland for fresh job opportunities.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">To benefit industries that rely heavily on an international workforce, the government has raised the Working Holiday Visa quote by 30% compared to last FY. Now, all skilled workers from eligible countries can travel to Australia and work under this program.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li aria-level=\"1\"><b>The Age Limit For Italian And Danish Citizens Will Increase From 30 To 35 Years Of Age<\/b><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The Australian government has further raised the age limit of Italian and Danish citizens from 30 to 35 years.<\/span><\/p>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li aria-level=\"1\"><b>Australian Visa Fees Undergoes Revision<\/b><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">If you&#8217;re a foreign worker from the skilled, visit, or <\/span><a href=\"https:\/\/immi.homeaffairs.gov.au\/employer-subsite\/Pages\/compare-sponsored-skilled-visa-options.aspx\"><span style=\"font-weight: 400;\"><span style=\"color: #3366ff;\">sponsored visa category<\/span><\/span><\/a><span style=\"font-weight: 400;\">, note that the visa fees for these categories have been revised, effective from 1st July Changing Their Courses<\/b><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">If you apply for a student visa post 1 July 2022, it&#8217;ll be subject to visa <\/span><a href=\"https:\/\/www.homeaffairs.gov.au\/nat-security\/Pages\/critical-technology.aspx#:~:text=If%20you%20apply%20for%20a,in%20the%20postgraduate%20research%20sector.\"><span style=\"font-weight: 400;\"><span style=\"color: #3366ff;\">Condition 8208<\/span><\/span><\/a><span style=\"font-weight: 400;\">, under which you must attain prior written approval from the Minister of Home Affairs (MHA) before <\/span><b><i>undertaking a critical technology-related course of study in the postgraduate research sector<\/i><\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">This includes:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A postgraduate research course, a master&#8217;s degree (research) or a doctoral degree level that relates to critical technology<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A bridging course identified as a prerequisite to a postgraduate research course pertaining to a critical technology<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A thesis or research topic for a postgraduate research course relating to critical technology<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li aria-level=\"1\"><b>Fair Work High Income Threshold Increases<\/b><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">From 1st July 2022, the <\/span><span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.fwc.gov.au\/high-income-threshold\"><span style=\"font-weight: 400;\">Fair Work High Income<\/span><\/a><\/span><span style=\"font-weight: 400;\"> threshold has been revised to\u00a0 $162,000 from $158,500.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Note: <\/b><span style=\"font-weight: 400;\">This raise may influence your eligibility if you wish to apply Program<\/span><\/a><\/span><span style=\"font-weight: 400;\"> or access age exemption in certain skilled visas.<\/span><\/p>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li aria-level=\"1\"><b>Australian Citizenship Payment<\/b><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">1st July 2022 onwards, you must pay for your Australian Citizenship application in AUD and not in foreign currencies.<\/span><\/p>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li aria-level=\"1\"><b>Change To Job Ready Program\u00a0 (JRP) Skills Assessment With Trade Recognition Australia<\/b><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The <\/span><span style=\"color:
